[공정위/CTN]가요진 기자= 공정거래위원회 관계자가 "앞으로 50일간 불공정 하도급 신고센터 운영을 통해 원사업자의 미지급 하도급대금에 대한 자율적 시정과 명절 전 하도급대금 조기 지급을 유도하겠다"라며 "중소기업의 자금난 완화와 함께 원사업자의 하도급법 위반을 방지하는 데 기여할 것으로 기대한다"라고 밝혔다. 공정거래위원회(위원장 주병기)는 올해 추석 명절을 앞두고 중소 하도급업체들이 대금을 제때 지급받을 수 있도록 2026년 8월 5일부터 9월 23일까지 50일간 '불공정 하도급 신고센터'를 설치 및 운영한다고 발표했다.

공정위에 따르면 명절 즈음 상여금 지급 등으로 중소기업의 자금 수요가 급증하는 점을 고려해 명절 전 하도급대금 적기 지급을 독려하고, 미지급 대금에 대해서는 원사업자의 자진시정이나 당사자 간 합의를 유도할 방침이다. 필요한 경우 현장조사를 통해 사건을 신속히 처리할 계획이다.

신고센터는 수도권 7개소, 대전 및 충청권 2개소, 부산 및 경남권 1개소, 광주 및 전라권 1개소, 대구 및 경북권 1개소 등 전국 5개 권역 12개소에 설치·운영된다. 공정위 본부와 지방사무소, 하도급분쟁조정협의회에 설치되어 우편, 팩스, 누리집, 전화상담을 통해 접수한다. 아울러 대한상공회의소와 한국경영자총협회 등 주요 경제단체에 회원사들이 대금을 제때 지급하도록 독려를 요청하고 주요 기업에도 조기 지급 협조를 요청할 예정이다. 지난 설 명절 당시 신고센터 운영을 통해 미지급 대금 총 182건 약 232억 원을 지급 조치하고 약 3조 4,828억 원의 대금 조기 지급을 유도했다고 덧붙였다.

이처럼 명절을 앞두고 자금난에 시달리는 중소 하도급업체를 위해 신고 전담 창구를 개설하고 주요 기업 및 경제단체에 대금 조기 지급을 요청하는 것은 하도급 거래 현장의 유동성 공급을 돕는 조치로 평가된다.

다만 매년 명절마다 반복되는 대금 체불 문제에 대해 강력한 법적 제재나 현장 단속 대신 원사업자의 자율적 시정과 독려 수준의 계도에 의존하는 것은 사후약방문식 생색내기 행정이라는 비판을 피하기 어렵다. 명절 특수철에만 한시적으로 센터를 열어 실적을 홍보하는 전시성 행정을 끊어내려면, 단발성 자진시정 유도에 그칠 것이 아니라 상습 체불 원사업자에 대한 징벌적 손해배상 적용과 과징금 부과 등 강력한 법적 처벌 체계 정립이라는 실질적 대안이 구축되어야 할 것으로 보인다.

The FTC also plans to request major business associations, including the Korea Chamber of Commerce and Industry, to urge member firms to release payments prior to the holiday. The FTC added that during the previous Lunar New Year, it facilitated the payment of 23.2 billion KRW across 182 cases of unpaid fees and induced early payments worth 3.4828 trillion KRW.

While opening dedicated dispute channels and asking major enterprises to expedite payments offers a plausible narrative for supporting SME liquidity, skepticism remains.

Critics argue that responding to chronic subcontract payment delays with voluntary guidelines and telephone consultations right before major holidays borders on reactive showmanship. To deliver real results beyond seasonal campaign announcements, the FTC must establish concrete policy alternatives, such as implementing punitive damages for habitual defaulters and enforcing strict, mandatory administrative sanctions throughout the year.
